Running Event Waiver Agreement

This Running Event Waiver Agreement ("Agreement") is made and entered into with "The Team Challenge at the Beach" and all of its staff and affiliates.

WHEREAS, Event Organizer is organizing a running event (the "Event") and

WHEREAS, Participant desires to participate in the Event.

NOW, THEREFORE, in consideration of the foregoing premises and the mutual covenants contained herein, the parties agree as follows:

1. Assumption of Risk. Participant acknowledges and understands that participation in the Event involves inherent risks, including but not limited to:

• Falls, collisions, and contact with other participants.

• Injuries arising from weather conditions, including extreme heat, cold, rain, or wind.

• Injuries arising from the condition of the course, including uneven terrain, obstacles, or traffic.

• The effects of exertion on Participant's physical condition.

• The potential for contracting communicable diseases.

Participant assumes all risks associated with participation in the Event, both known and unknown.

2. Release and Waiver of Liability. In consideration of being permitted to participate in the Event, Participant hereby agrees to release, hold harmless, indemnify, and discharge Event Organizer, its directors, officers, employees, volunteers, sponsors, and agents (collectively, the "Released Parties") from any and all claims, demands, losses, or liabilities arising out of or in any way connected with Participant's participation in the Event, including but not limited to claims of personal injury, death, or property damage.

3. Medical Fitness. Participant represents and warrants that Participant is in good health and physically fit to participate in the Event. Participant further acknowledges that Participant has consulted with a physician regarding Participant's ability to participate in the Event.

4. Event Rules. Participant agrees to abide by all rules and regulations established by Event Organizer for the Event. Event Organizer reserves the right to disqualify Participant for violation of any such rules or regulations.

5. Medical Treatment. Participant authorizes Event Organizer to secure medical treatment for Participant in the event of an emergency. Participant agrees to be responsible for all costs associated with such medical treatment.

6. Use of Image. Participant grants Event Organizer permission to use Participant's name, image, and likeness in any photographs, videos, or other recordings of the Event for any purpose.

7. Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

8. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of NY.

9. Severability. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
